Points Based System [PBS] launched today
29th February 2008

The new Points Based System [PBS] is taking effect from today; Tier 1 for Highly Skilled Migrants is the first of five separate Tiers, providing a robust and measured means of ensuring that only the best can work in Britain. Other changes include the introduction of new licences for employers that wish to employ migrant workers, which will be a mandatory requirement for Tier 2 Work Permit applications, which are due to take effect in Autumn 2008, together with on-the-spot fines being issued to those employers that do not confirm to the rules and anyone found hiring illegal workers in the UK.

I don't have a job offer will this affect my chances of making a successful HSMP application?
No. Your application is considered on balance of what you have achieved to date [how many points you can claim] and your earning potential if the application is approved.

I am currently on a UK Work Permit, what happens if my HSMP application is refused?
The HSMP application is requesting permission from the Home Office for permission to change status. If this permission is not granted, your work permit will not be affected.

How long does the application process take?
The current HSMP scheme has just reopened for new applications (5th December 2006) new cases are still being considered, a timescale will become available in the next couple of weeks.

What is graduate level work experience?
No work experience of any kind is assessed in the new HSMP, highly Skilled Migrant Program scheme.

My salary for the past 12 months is split into basic salary plus allowances. Does the Home Office take allowances into consideration?
Yes. If the allowances are clearly declared on your original payslips, this can be used to support your application. However, we can advise on the most appropriate way to demonstrate your earnings.

What do I do next?
