Points Based System [PBS] launched today

The new Points Based System [PBS] is taking effect from today; Tier 1 for Highly Skilled Migrants is the first of five separate Tiers, providing a robust and measured means of ensuring that only the best can work in Britain. Other changes include the introduction of new licences for employers that wish to employ migrant workers, which will be a mandatory requirement for Tier 2 Work Permit applications, which are due to take effect in Autumn 2008, together with on-the-spot fines being issued to those employers that do not confirm to the rules and anyone found hiring illegal workers in the UK.

Highly Skilled Migrant Programme Highly Skilled Migrant Programme

As of November 7th 2006 the Home Office changed the way the Highly Skilled Migrant Programme is awarded. Applicants applying for the scheme will be judged under a new enhanced points based scheme designed to better reflect the individual's skills and likely success.


The Highly Skilled Migrant Programme [HSMP] is designed to allow individuals with exceptional skills and experience to work in the United Kingdom. It allows an individual to enter or remain in the UK without necessarily having an offer of employment, or to take up self employment opportunities.

What has changed?

In addition to the minimum required points being raised from 65 to 75 there have been changes to the points categories; work experience, significant achievements, skilled partner and GP priority categories have all been removed. New attributes will be academic qualifications, previous earnings, age and bonus points for previous work and study in the UK.

The MBA provision for HSMP which allows holders of MBA provisions from designated institutions will remain. There will also be a mandatory English language requirement.

  • Skilled Partner

New Categories:

  • Academic Achievements
  • Previous Earnings
  • Age
  • Previous Work or Study in the UK
  • The MBA Provision will remain
  • Mandatory English Language Requirement (IELTS Level 6 or equivalent)

The HSMP changes come into effect on the 8th November 2006. In order to prepare applicants and allow a smooth transition to the new scheme the HSMP provision will be suspended until 4th December 2006, the revised scheme will be operational from 5th December 2006 after a 27 day break.

It is our responsibility to ensure that your HSMP application is fully supported in each area which we consider that you can claim points for. Please remember that original documents are required, photocopies are not accepted.

Where can you claim points?

There are five key areas which you can claim points;

Education
You must have completed a recognised course at a degree level or higher. If your qualification was gained from overseas, you would need to show what it is equivalent to www.naric.org.uk

Past Earnings
This will be used to determine the level of your employment to date and also your potential earning power in the UK. You have to show your earnings for the past 12 months of your employment.

MBA Provision
You must have completed your course from one of the top 50 MBA programmes in the world to score points in this category.

Age
If you are under 32 then you can claim points depending on how old you are. Individual's over 32 cannot claim points in the age category, but may still qualify with points from other categories.

Previous Work or Study in the UK
If you have worked or studied in the UK before you may be able to claim bonus points in this category.

Additional Requirements

English Language
You must be have good English language skills, both written and spoken and be able to prove this, otherwise your application will be refused, even if you meet the points scheme.
