Points Based System [PBS] launched today
29th February 2008

The new Points Based System [PBS] is taking effect from today; Tier 1 for Highly Skilled Migrants is the first of five separate Tiers, providing a robust and measured means of ensuring that only the best can work in Britain. Other changes include the introduction of new licences for employers that wish to employ migrant workers, which will be a mandatory requirement for Tier 2 Work Permit applications, which are due to take effect in Autumn 2008, together with on-the-spot fines being issued to those employers that do not confirm to the rules and anyone found hiring illegal workers in the UK.

The Home Office will assess your application against your intentions and ability to undertake the course of study that you are applying for; you will also be required to show that you can maintain yourself and any dependents in the UK without access to public funds. There are several different types of status that allow individuals to come to the UK and study. This can be for short term courses, professional and vocational qualifications and degree courses or higher. You should always seek professional advice to ensure that you are making the correct application for your needs.

Students are normally permitted to work up to a maximum of 20 hours per week in part-time employment during term time. This can be full time in vacation periods. Dependents of those on a student visa [spouse, children] should be allowed to work in the UK, as long as they have permission to remain in the UK.

The rules that surround student visas can be quite complex. Making an incorrect or poorly supported application could jeopardise your chances of remaining in the UK. It is also important to consider whether you are permitted to switch from your current student visa into another immigration category.
