Codes of Practice Released Under New Points Based System [Tier 2]
17 September 2008 The Codes of Practice have now been published today marking a significant point in the development of the Points Based System. These are very important documents which set the benchmarks for salaries in the Tier 2 category and levels of skilled jobs that will be allowed under the issue of Certificates of Sponsorship for migrant workers. Some salary bands may come as a surprise to many employers.

Points Based System

The Points Based System [PBS] will be used by the UK Border Agency to assess whether an individual qualifies to come to the United Kingdom for the purposes of work or study There are five separate Tiers in which an application can be made; these replace the previous immigration categories where appropriate. - Tier 1 Highly Skilled
- Tier 2 Skilled Workers with a Job Offer
- Tier 3 Low Skilled Workers
- Tier 4 Students
- Tier 5 Youth Mobility and Temporary Workers
Each Tier has a separate set of assessment criteria that has to be met by the applicant at the time of application, to demonstrate that s/he has sufficient points to qualify under the relevant scheme. If the application and the supporting documents cannot be independently verified then the application will be refused by the UK Border Agency. In addition to being able to show that the person has enough points to qualify, the applicant will also be required to show evidence that there is a sponsor in the UK who is supporting the application [except for Tier 1 applications]. The sponsor must be a business or college in the UK and be licenced by the UK Border Agency before an application can be made under the Points Based System. |
