The qualifying criteria and conditions are different, depending on whether the application is for a restricted or unrestricted CoS. We will make a full and detailed assessment to ensure that the post meets the relevant criteria.

Applicants must meet the standard criteria for Tier 2 General as specified in the relevant Code of Practice. This will be decided by an independent panel once per month. However, restricted CoS applications will be decided against strict assessment criteria, with priority given to shortage occupations, high level research and senior positions:

Applicants must meet the standard criteria for Tier 2 General as specified in the relevant Code of Practice.

Tier 2 General can be extended with the same employer or with a different employer (if the new employer holds a valid sponsorship licence). The post will need to be carefully assessed whether it meets the relevant codes of practice at the time of application.

Tier 2 General migrants can qualify settlement in the UK after five years if the applicant has completed five years lawful and continuous employment in the UK and has passed the knowledge of life and language in the UK test.
