The qualifying criteria and conditions will change depending on which sub-category is applied for.

• Short term
  Applicants will be granted up to a maximum of 12 months stay in the UK. All applicants must have at least 12 months experience with the organisation directly prior to the transfer. The salary package must exceed £24k per annum. Accommodation allowances cannot make up more than 40% of the salary package.



• Long term
  Applicants will be granted up to 3 years initially with the ability to extend up to a maximum of 5 years stay in the UK. All applicants must be paid over £40k per year. Accommodation allowances cannot make up more than 30% of the salary package.



• Graduate trainee
  Applicants will be granted up to a maximum of 12 months stay in the UK and cannot re-enter the UK under any other ICT sub-category (except Long term) within 12 months. All applicants must have at least 3 months experience with the organisation directly prior to the transfer and be transferred as part of a structured development programme (with clearly defined progression towards a management or specialist role within the organisation). The salary package must exceed £24k per annum. Accommodation allowances cannot make up more than 40% of the salary package.



• Skills transfer
  Applicants will be granted up to a maximum of 12 months stay in the UK and cannot re-enter the UK under any other ICT sub-category (except Long term) within 12 months. Applicants must be able to show that the sole purpose of the transfer is to acquire / impart knowledge and skills which are incidental to overseas employment. The salary package must exceed £24k per annum. Accommodation allowances cannot make up more than 40% of the salary package.

There are transitional arrangements in place for those who were granted permission to stay before 06 April 2011. Extension applications will be granted as long as all criteria continue to be met at the time of application.

• Short term
  Applicants can apply for an extension if this does not take their total stay beyond 12 months in this sub- category.



• Long term
  Applicants can apply for an extension if this does not take their total stay beyond 5 years in this sub-category.



• Graduate trainee
  Applicants can apply for an extension if this does not take their total stay beyond 12 months in this sub-category.




• Skills transfer
  Applicants can apply for an extension if this does not take their total stay beyond 12 months in this sub-category .

Tier 2 Intra Company Transfer migrants can no longer qualify settlement in the UK.

There are transitional arrangements in place for those who previously entered the UK before 06 April 2011. The application can be submitted once the applicant has completed five years lawful and continuous employment in the UK and has passed the knowledge of life and language in the UK test.
