There are a number of ways that a Bulgarian or Romanian national can come to the UK to live and work. The assessment criteria will change depending on which category the person is applying under.
Alternatively, it is possible for the person to remain in the UK for the purposes of study, self employment or on the basis of economic self-sufficiency. This type of status does not require a work permit. The person will still require a registration certificate which may carry employment restrictions.

Highly Skilled Migrant Programme (HSMP)

Work Permit
There are a number of sub-categories of work permit as follows:
• Business and commercial - skilled employment
• Training and work experience - to gain skills and experience through work-based learning which can be used overseas
• Sports and entertainments - for international performers of the highest standard, who can make a significant contribution to entertainment or sport in the UK
• Sector based scheme - for low skilled workers to work in the food manufacturing sector.
• Student internships - students who are studying first or higher degree courses overseas to take part in an internship with a UK employer.
• General Agreement on Trade in Services - For overseas employees whose employer does not have a commercial presence in the European Union. To allow workers to work in the United Kingdom on a service contract awarded to their employer by an organisation based in this country.
Seasonal Agricultural Workers Scheme
The SAWS is designed to allow farmers and growers in the United Kingdom to recruit low-skilled overseas workers to undertake short-term agricultural work. The scheme works on a quota basis. Farmers and growers who participate in the scheme are allowed to employ a fixed number of overseas workers though the scheme each year. In 2010 and 2011 the quota is 21,250 places.
